Mix-up leads to teen suspect’s release

A convenience store robbery Tuesday would have perhaps never have happened if it hadn't been for an apparent mix-up in paperwork that allowed the teenage suspect to be released from jail.

Clanton police officers and Chilton County sheriff's deputies continue searching for Timothy Jake Wells Jr., 19. Warrants have been signed for his arrest in connection with Tuesday night's robbery of the B.P. Station near McDonald's, according to Police Chief Brian Stilwell.
A white man entered the store with a handgun around 7:30 p.m., demanding money and making off with the cash register. The suspect fled in a white Chevy pick-up truck.
According to court records, District Court Judge Rhonda Hardesty signed an order Sept. 3 revoking the bond of Timothy Jake Wells Jr., but Sheriff Kevin Davis said the county jail never received the mandate.
Wells was first arrested July 1 for allegedly trying to steal a 4-wheeler from Action Motorsports in Clanton. He posted bond July 9 and was released from jail.
The Verbena resident was arrested again Sept. 1 on several charges, including robbing the Shell Sunny Foods Store on July 14.
After the second arrest, Assistant District Attorney Jessica Sanders asked that Wells' bond from the initial burglary and theft charges be revoked.
Hardesty granted the request the same day, Sept. 3, requiring that Wells be held without bond on those charges until a Sept. 17, according to court records.
Before the hearing could take place, Wells was released from jail Sept. 8, after posting bond on charges in connection with his second arrest, according to Chilton County Circuit Clerk Glenn McGriff.
The mix-up apparently happened somewhere in getting paperwork from the circuit clerk's office to the county jail.
McGriff said he didn't know why the message didn't get communicated.
"It was a breakdown in communication," said McGriff. "He was released and should have been kept until a hearing to revoke his bond before Judge Hardesty."
Davis said his office never received an order to keep Wells in jail.
"We never received an order to hold him. Every charge he has been booked for at the Chilton County Jail, there was a bond for," Davis said. "Once the bond is paid, I have no right to continue to hold him ... I can only act on paperwork I receive."
Wells never showed up for that hearing, according to court records. He knew prosecutors were asking that his bond be revoked because Sanders had already served him a copy of the request given to Hardesty.
Had the hearing taken place, prosecutors would have asked that Wells’ bond be revoked until trial, which Hardesty could have agreed to or not.
District Attorney Randall Houston said bond is set in almost all cases. Prosecutors can ask that no bond be set, but that is usually only done in capital cases, Houston explained. Instead, the state more commonly asks that bond be revoked on previous charges for repeat offenders. That's what happened in Wells' case and that's why he had a bond set for his second arrest.
Wells has been charged with a rash of break-ins and robberies this summer.
From his previous arrests, Wells faced two counts of first-degree robbery, seven counts of third-degree burglary and nine counts of theft of property.
Stilwell said his department's main goal now is to get Wells off the streets.
"We really want to get him off the street before somebody gets hurt. We don't want him to hurt himself, a store clerk or a police officer," Stilwell said.
The Chilton County Sheriff's Office is assisting with the case, Stilwell said.

Well, that was a pretty big mixup!! I know it's tough times right now and I don't want anyone to lose their jobs but somebody needs to get severely reprimended!!

Mistakes seem to happen a lot more recently since the new "sheriff" and his bunch took over. It is amazing how Kevin quicly tried to lay blame elsewhere but if memory serves me correctly the rulings and orders from the judge return to the jail with the inmate..... makes you wonder about the administration if this is STILL true.....

sounds like somebody put the heat on someone to take responsibility for this mix-up like right now.
Ahh! now Mr. McGriff what do you have to say for yourself my friend. Are you trying to destroy your career or could you just be taking the fall for someone Else's carelessness.
And by the way since the circuit clerks office has not been serving process on bond forfeitures in the last two or three years at least those signed by bail bondsmen and if i understand this guy failed to appear who is liable to turn him over or pay up.
or will this responsibility rest on the shoulders of the law enforcement when someone apparently profited from his release.
And my point being if someone was compensated upon his release but the law enforcement are the ones seeking his apprehension it appears to me that the tax payers are the ones on the losing end of the stick. or should i say at the end of the barrel of this armed robber.

Well, it looks like unfair was at least somewhat right, but the whole story still isn't out.
Curious about something though, sheriff. While I'm sure that you are right in that if someone posts bond you have no right to keep them, BUT, with a prisoner that has the recent record that this idiot has accumulated in such a short time couldn't you (or someone on your staff) have at least made a phone all? And, are you going to get to the bottom of the communication mixup and let us know how it happened at what corrective action is being taken to keep it from happening again?
kw: I wondered about that same thing. Maybe the water was starting to get a little hot, who knows? I just wonder now if there will be another communications mixup if they catch him AGAIN, hopefully before he holds up yet ANOTHER store and maybe killing someone this time. I would expect that folks are already in CYA mode incase some innocent person does get hurt or killed by this fool that should still be sitting in the Chilton Hilton.

I think someone should notify the TV news station and get some real coverage on this event. I would but I'm scared of the repercussions i might endure.
To tell the truth this updated statement sounds like an attempt to cover up or maybe the new blogger (unfair) is the guilty culprit after all "unfair" seemed to have information that the rest of us did not or maybe "unfair" is just that much more intelligent than the rest of us.
And if the elections were held tomorrow does this update change the opinion of how the polls would turn out.

This whole episode sounds like the Key Stone Cops. Everyone running around bumping into each other and no one knowing where they are supposed to be, or what they should be doing. Make anyone feel safer?

This is real comforting. Hope everyone slept well last night, cause I sure didnt. I was hoping to read this mornings head lines and see that he was behind bars and instead I see that because of someone's mix up I have to be afraid that he will come back into my home. Yes I said BACK. Look like someone needs to hire a new secretary because he\she are now keeping up with their work load.

I love all of you, you have made my day with your comments...This is bad for our county, but in a good way...The more of you who are willing to speak out the better. I have children like most of you here, and I want them to be kept safe and if our county is not doing that and clearly they are not, then we need to do something about it. We have every right to speak out about our concerns and get to the bottom of this. First Amendment of the U.S. Constitution allows us to do so. We are NOT a communist country, but if this keeps up it could lead to that. God Bless all of you, and kudos to the Clanton Advertiser for letting the public actually say what needed to be said on your site. This has been a long time coming for our county and these people need to be heard...Thanks so much!!

Hopefully they will capture him today asap. This story reminds me of a bunch a kids that did something wrong and no one wants to take the blame. When this is the case I say punish the whole bunch!!!

Just a question/thought as I do not know the workings of the Criminal Justice system....in the modern day of technology, why isn't the court clerk notifying, by email, the municipalities/counties when bail is revoked - subject line - BAIL REVOCATION or whatever. At least this gives the necessary parties a heads up as to look for the paperwork

They've got to catch him and KEEP him in jail before they can do that. The catch and release program isn't working out too well for us citizens. Good for fish, bad for honest citizens.

My question of the day is as follows: For all the people on here yesterday stating what an idiot Rhonda or Sibley must be, do you now feel like an idiot?
Had they called the judge's, clerk's or sheriff's office and asked what happened prior to asuuming things and making comments without knowing the facts they would of known how this happened.
Does anyone of you that called the judge an idiot want to step up to the plate and apologize or at least admit they were wrong???????? We are all wrong at times and should admit it when we are.
I hate the mixup happened and steps should be taken to see that it does not happen again. I am sure Glenn McGriff will maken effort as far as his office is concerned.
I am not making excuses for it happening, but things do happen. I am sure we have all goofed at times and had to face the music as I am sure whoever let this happen will.

southernpride: Let make sure I answer your first question so that you can understand it, just pretend that it's written with a crayon; NO, that's my answer. I don't think anybody said that either judge was an idiot, though sometimes that might apply, at least to one of them. I (we) were responding to an article written by The Advertiser which stated that this fool had been released ON BOND. Now, let me ask you, do you research every story that you comment on in this forum? I rather doubt it. If we can't rely on the newspaper to give a factual and complete report of a story then these are the things that will happen. I hope that cleared it up for you a little bit.

My opinion about either Judge especially Mr. Reynolds has nothing to do with this article. It is from injustices and burdens he has placed on innocent people from the past and not criminals just an average senior citizen couple who was stripped of everything they ever worked for even their very freedom and dignity as human beings and thrown into a nursing home where they later died.
And for years they thought he was their friend. And I'm not talking about people who had nothing surviving off the system, these people were financially more stable than many people in this county. And there are many people who were very disturbed by his actions against these people and i still have people to confront me letting me know how wrong they thought this was and this took place a few years ago. But sadly i was the only friend who tried to step up and speak up for them.
So yes to answer your question, I have no respect for Mr. Reynolds and never will as long as i live. Not unlike many others in this county, And of all their friends in the community not one did i see in the court room hearing to speak up for the rights of these people, but still to this day they will tell me how wrong it was to take everything these people had and throw them somewhere they did not want to be, but in my opinion to acknowledge that and not speak up for their rights makes them no better.

I’m back!!! First of all let me say that I have not read all the comments that have been posted to this article nor the one from yesterday. I generally don’t read this stuff for two reasons. The first one is that more than half the time the information that was printed in the paper is wrong, second I don’t usually respond to the comments of people who think they know what is going on but really don’t. Court records are public record. You can go up to Glenn’s office and he will let you look at whatever you want to except for the juvenile stuff. If you do a little research you will find that the district Judge Rhonda Hardesty is fourth in the state in the number of cases she handled last year. She took care of over 16000 cases. It’s just her and her one assistant. That’s all. I have no idea how many cases that the circuit judges handled, but it is a large number also. Glenn’s office has to handle all of the above. That’s a lot of paperwork from only about seven employees. Every now and then a mistake is made. There is great care taken to try to not make any mistakes because those people that work up there know that these cases effects people’s lives. However, when you handle that many cases it’s going to happen. Trust me when I tell you that you are getting you’re moneys worth out of your court system employees. They have to handle the worst things that happen in society. You know if a judge is doing their job they are going to make a lot of people mad everyday. That’s just the nature of the beast. Are there judges that do things wrong and make wrong decision? Sure there are. It’s just that unlike most of us when they make a mistake it gets put in the paper and on the news. What if every mistake you made was made known to everyone everywhere how would you feel? Now I know that there are those of you who will disagree and that’s fine. That’s what all those people that fought in WWI, WWII and so on died for. You’re freedom to voice your opinion. This is a great country and we have some great leaders. We also have some that’s not so great. So goes life. With that said I’m signing off forever. I won’t be back. You guys keep voicing your opinions, I would hate to know that all those people that have died over the years did it for nothing.

Why are some of you so quick to blame the sheriff?
Looks to me like this is the fault of the Clerk's office. When you elect someone who has no prior experience in the deals with this office, this is what you get.
Prior to his election, the most experience Glenn had in "law enforcement" was getting a traffic ticket.
When an election becomes a popularity contest, rather than a measure of merit, you get silliness like this.

The elderly man whom i spoke of in my earlier comment fought in WWII and received numerous metals. and look how our system repaid him. You need to be preaching that sermon on the mount of the court house.

You are correct in the fact that Mr. McGriff didnt have a prior knowledge of this office, but neither did his predecessors before him. they were given the opportunity to learn. And as far as i am concerned Mr. McGriff should have the same opportunity. If this office is outside his ability in time we will know and will have the opportunity to replace him with someone else. But even so i think as a person Mr. McGriff seems like a genuine guy. It would take many years in my personal opinion for anyone to handle that job as well as Mike Smith but even under his appointment there were mistakes made. And as far as prior law enforcement experience goes I dont think that is relevant to the problem. I dont have prior law enforcement exp. but i think i could make as good a servant to my county as the past three sheriffs we have elected. and while i dont say this as a degrading statement to Kevin Davis i do see room for improvement. there is a need for a major attitude adjustment in his department and a greater respect for the public as they do not seem to realize not all citizens are outlaws and criminals. And the only way you can gain a true confidence in the people is to be interactive with the community you serve and know their concerns and treat the citizens as you would those of your own family. The way i see it anybody in a leading position is only as respected as those who serve under his authority.

well since they haven't cought him yet i don't think they will...not in chilton county anyways...any one who robs a store with out trying to hide who they are would be crazy to stick around...but then again you never know he's done some pretty foolish things before... no telling what he will do next!!

Still everyone wants to blame everybody except the person that signed the bond. The criminal did not get out on his own. He wasn't allowed to sign his own bond. Find out who signed the bond and hold them responsible. I'm glad to see someone post a comment about the overwhelming amount of work that these offices handle. And the numbers that were posted about what goes throught this Circuit Clerks office and the District Judges office, the jail also handles these criminals and the criminals from the 5 municipalities in the county. Yes in this case it happens to be on a bigger idiot than most and it made the paper, but mistakes happen and everyone shouldn't be ready to form a lynch mob and storm the courthouse steps. This idiot WILL be caught or he will get out of Chilton County in which case he will be caught somewhere else and the sheriff's dept will go get him.

I dont really think anybody actually wants to lynch anyone, but in light of recent events and this guys particular behavior i dont think anyone is out of line being concerned for their safety or the safety of the community as a whole. This guy is very young which is a very sad situation in its self. He is also very inexperienced in life and extreme situations of any-kind right or wrong which makes him even more dangerous to himself and anybody he confronts. I cant think of anyone who would not question what has happened here or anyone who would not want to hold someone responsible if someone should lose their life before this string of events plays its course. Hopefully all will end well without any loss of life including his own. But you must also keep in mind the long term mental stress that can result on behalf of the victims who are being robbed at gun point and each day they must return to work in fear of their life but have no options in the matter of supporting their families and that alone should be enough to get people involved and questioning even honest mistakes. maybe some of you that dont understand the frustration should talk to someone who has been the victim of an armed robbery or attack or better yet someone who has been shot in a robbery or any other extreme situation and survived. I would also hate to know i had to live each day knowing i had to take the life of a 19yr. old child regardless of the reason.

Mistakes are made. After all Chilton County has the same size county jail as say New York. The Sheriffs deputies here see so many different criminals from outside of the county that no one could have possibly noticed this teenager who has never been seen in the jail. I would only imagine with the large size of Chilton County that more than likely none of our law enforcement knew who this was. It is not like we are in a small rural community where everyone knows your name. There are so many bail bondsmen here that when he was a failure to appear, no one could remember who held the paper work for his bond. So, even though he is a teenager and his bond was signed, the day of his FTA ... no one went to collect or try to find him. These are the things that happen when we live in a large metropolitan area. Ever wonder what it would be like to live in an area where everyone knows you name?

I dont know if anyone heard this or not but it should be on "WORLDS DUMBEST CRIMINALS"!!! This young man, when he robbed the station in Verbena went in the car that the attendant there had JUST sold his mom! He wore a pajama leg with holes cut for eyes and after fleeing the place the attendant looks out and recognizes HER old car driving away!!! She gets on the phone and calls the mother that lived JUST down the road and ask her was her son driving the car? She said he was and she told her "I THINK he just robbed me!". The mom goes into his bedroom and said, "Well, this is strange? There is a pair of scirrors and his pajamas with only one leg!?!" .....doesnt take a rocket scientist now does it!

Bamagal's info is correct; Wells is in custody thanks to our great Sheriff's Dept and Clanton PD! Our guys worked hard and it has paid off! Thank you so much for all you, it's greatly appreciated!
